Default and late payments/fees: Should you default on any payment obligation as called for in this agreement, the club or its agent will have the right to declare the entire remaining balance due and payable and you agree to pay allowable interest, and all costs of collection, including but not limited to collection agency fees, court costs, and attorney fees.

NOTICE: Any holder of this agreement is subject to all claims and defenses which the debtor could assert against the seller of goods or services obtained pursuant hereto or with the proceeds hereof, recovery hereunder by the debtor shall not exceed amounts paid by the debtor hereunder.

I understand that upon purchasing this membership, I am making a legal commitment to complete the {{amount of months}} month membership and {{1 month payment/monthly payments stated in this contract. I understand that I have 3 days (not business days) from the signing of this contract to cancel (Day 1 is date of signature/signup date) by written notification. If 3 days have passed with no written notice of cancellation, I agree to be bound by its terms and conditions. If services were used within this 3 day period, I may still cancel, but will need to pay for the services used during this timeframe, plus resign my enrollment fee. If cancellation is given within 3 days and no services are rendered, my enrollment fee will be refunded via check within 10 business days.

To freeze or cancel my membership I must do one of the following. If I am unable to produce any of the following, I will not be able to cancel or freeze my membership.

Medical Freeze: Bring in a medical note from a medical doctor stating that I am unable to use my exercise program. This note must state the duration for which I will need to freeze my membership and must be on letterhead from the doctor (e-mails written from a doctor's office are not accepted, unless a note on letterhead has been scanned into an e-mail). Accounts will not be frozen until the date the medical note is presented.
Medical Cancellation: If a medical cancellation of my membership is necessary, the letter must state that I will be unable to return to a physical activity program. My membership will be prorated from the time of my last payment (last payment date being day 1) to the date of proof of cancellation. My account will remain on autodraft and will not be considered canceled until valid proof is shown (as noted in clause #1). All sessions previously paid for that may not have been used, will be void.
Other freeze: Pay a $30.00 fee for each month I want to freeze my membership without a medical reason. Paying $30.00 will freeze my membership for one month (30 days). For a twelve month contract, I can freeze my membership for a maximum of 2 months (60 days) throughout the entire contract, and must be done in 30 day increments. My final payment date will also be pushed back in accordance with the freeze period. I must notify {{Company Name}} of my intent to freeze at least 14 days prior to my next draft date to freeze my membership. If my intent to freeze is not given within the 14 days of my next draft date, I will need to pay the membership dues and my account will be frozen from my draft date for the next 30 or 60 days. I may return to the gym 30 days (or 60 days) from the date of my freeze notice.
Grace Clause-If I decide I will not honor the remainder of my contract, at any time, for any reason (except #2 and #4 above), I agree to give a 14 day written notice of my intent, and agree to pay a buy-out fee of 3 months of membership. A buy-out is determined from the date the written notice is given, and payment method arranged. If I have not used my membership for any length of time prior to my buy-out notification date, this will not count towards the 3 payments that will need to be paid to {{Company Name}}. The 3 months begin after my notice, and my account is current (memberships are paid for in arrears). If I do not provide at least a 14 day notice of my intent and my payment falls within the next 14 days (day 1 of the notice is considered to be the day the written notice is given), my account will be considered not current, and my next payment will be due in addition to the 3 month buy out. If I give a 14 day notice and my next payment does not fall within the 14 days, my account will be pro-rated from my last payment date until the current date (day one considered to be the day my last autodraft payment was withdrawn, and counted forward to the date of intent to cancel). All unused sessions previously paid for will be void, and unavailable for use. If my 3-month buy out is not paid, I understand the total remaining balance on my account will be sent to First Credit Services, including any fees such as declined charges, and all late charges/statement charges.

Trainer/Session Cancellation Policy:

I understand that there is a 24-hour cancellation policy at {{Company Name}} for all scheduled coaching calls. If I do not cancel my appointment twenty-four hours in advance, a session will be deducted from my monthly paid for sessions.

Session Expiration:

I also understand that I receive a certain number of training sessions per month (noted at the top of this contract), and if I fail to use them by the end date of my contract, all sessions will expire 30 days from my final draft date. Session Expiration Date: {{Contract_Expires_Date}}

All memberships are non-transferable. All pre-paid contracts and services are non-refundable.
